Accessible parking rights come back as the same old drama, because Thailand🇹🇭 lacks a complete control system. Society is left with the mess we see.
Ministerial Regulations on Facilities in Buildings, 2548 and 2564, set minimum bay numbers, sizes and who may use them. But the disability network and the Foundation for Children with Disabilities report no placard or permit system, no clear penalty, and no agency handling disabled parking enforcement. Bays get built, yet unentitled drivers take them.
The United States🇺🇸 fixed this with a 4-layer system that works as one. Control comes first.
Layer 1, control. The Americans with Disabilities Act, or ADA, covers design and counts. 2010 standards require at least 1 accessible space in lots of 1-25, and 1 van-accessible space per 6.
Layer 2, permits and placards. Each state’s Department of Motor Vehicles (DMV) issues them. California offers permanent and temporary hanging placards, renewable online each cycle. They belong to the person, who must be in or near the vehicle.
Layer 3, penalties. This layer is what gives those rights real meaning. California fines counterfeit or borrowed placard use $250-1,000 (about 9,000-36,000 baht), under California Vehicle Code §4461 (§4463 covers forgery). Washington State’s $250 fine plus a $200 mandatory fee is $450 (about 16,200 baht), under RCW 46.19.050. The 2025 federal ADA civil penalty is $118,225 (about 4.3 million baht) per violation, replacing 2024’s rate. The owner or business pays it, not the driver.
Layer 4, promotion and support. The public can complain to the U.S. Department of Justice, staff are trained, and plain guides let owners self-check.
Thailand can do the same. We need only fill the missing layers: a permit system for those who qualify, an agency responsible for enforcement, enforceable penalties, and a public complaint channel. With all 4 layers, bays return to those entitled.
